The following Rules and Regulations are a part of your agreement with the park for the space you have rented. Please read the Rules and Regulations carefully. The management will interpret and enforce these Rules and Regulations in a reasonable manner. Check back on these Rules and Regulations regularly for changes, additions and deletions. These Rules and Regulations are in force as of 12/2008. Where "Parkway Lakes RV Park" is mentioned it is to include, in it's meaning, "Morgan Hill Parkway Lakes KOA."

1. USE OF FACILITIES.

RVers have the right to use the Premises and Park facilities in compliance with these Rules and Regulations and the other provisions of the Park's residency documents. RVer agrees that the enforcement of the Rules and Regulations and conditions of tenancy are a private matter between Park Management and each person individually. RVer agrees that RVer is not a third party beneficiary of any other agreement between Owner/Park Management and any other person in this Park. Site assignment and placement of RV shall be determined by Park Management and may be changed at any time as park demands necessitate.

2. COMMUNITY STATUS.

Morgan Hill Parkway Lakes KOA/Parkway Lakes RV Park is an all age community with no minimum age requirements for tenancy.

3. DEFINITIONS.

The definitions set forth below shall apply unless the context indicates that a different meaning is intended.

A. "Park" means Morgan Hill Parkway Lakes KOA/Parkway Lakes RV Park

B. "Owner" refers to Owner of the Park and the Management of the Park. (herein referred to as the "Park Management")

C. "Recreational Vehicle Park Occupancy Law" means those provisions of the California Civil Code Sections 799.20 et seq.

D. "RVer" is the person who has established tenancy in the Park pursuant to the Recreational Vehicle Occupancy Law and who lawfully occupies a recreational vehicle located in the Park.

E. "Recreational Vehicle" (also "RV") means a motor home, travel trailer, or park trailer as defined in Health & Code Section 18010 and referenced in Civil Code Section 799.29.

F. "Premises" means the real property (which is a recreational vehicle space) rented to the RVer by Owner.

G. "Guests" includes all of the RVer's agents, employees, persons sharing the Premises pursuant to Civil Code Section 799.25, invitees, permittees, or licensees or other persons in the Park or on the Premises at the invitation, request or tolerance of RVer and/or Park Management.

H. "Park Facilities" means the services and facilities of the Park.

I. "Park Management's approval", "approval of Park Management" or "Park Management's consent", consent of Park Management" or other similar terms as used in these Rules and Regulations or in other documents referred to in these Rules and Regulations, means that Park Management's prior written approval must have been obtained by RVer before RVer commences any such action requiring Park Management's approval. If Park Management's prior written approval is required, RVer shall submit a written request to Park Management to which describes the action RVer proposes to take and request Park Management to give prior written approval.

4. COMPLIANCE WITH LAWS AND RULES AND REGULATIONS.
 

A. RVer and guests have the right to use the Premises and Park facilities only if they comply with these Rules and Regulations and the other provisions of the Park's residency documents.

B. RVer agrees to abide and conform with all applicable laws and ordinances, all terms and conditions of these Rules and Regulations, all rules, regulations, terms and provisions contained in any document referred to in RVer's rental agreement, and said rules, regulations, terms and provisions as may from time to time, be amended, modified or otherwise changed by Owner.

C. Park Management will attempt to promptly, equally and impartially obtain the cooperation and compliance of all residents with respect to the Rules and Regulations and other conditions of residency. RVer recognizes, however, that Park Management's ability to obtain compliance is dependant on a number of factors, including the cooperation of all residents and their guests. RVer agrees, therefore, that enforcement of the Rules and Regulations and conditions of tenancy are a private matter between Park Management and each resident individually. RVer agrees that RVer is not a third party beneficiary of any other agreement between Owner/Park Management and any other resident in this Park.

D. RVer must recognize that Park Management will not be responsible to RVer for normal day to day disturbances that may result from the close proximity of other residents and persons within the Park. Park Management will not be liable to RVer for monitoring each routine disturbance, disagreement or minor problem that may occur between neighbors. If RVer is unreasonably disturbed or bothered by the activity of another resident or the guest of another resident , RVer should attempt to reasonably resolve any such problem.

E. Any violation of the Rules and Regulations shall be deemed a public nuisance. RVer agrees that a breach of any of the Rules and Regulations cannot reasonably or adequately be compensated in damages in an action of law and, therefore, Owner shall be entitled to injunctive relief including, but not limited to, restraining RVer from continuing to breach any such rules or regulations, term, or condition, or to allow a condition in violation of a rule or regulation, term or condition to exist or continue to exist..

5. PARK PERSONNEL.

Owner shall be represented by Park Management who is vested with all the legal right and authority to enforce the Rules and Regulations on behalf of the Park's Owner.

6. GUESTS.

A. For any guest to enter the Park they must first register at the office. There is a charge for any guest in the Park past 10:00 p.m.

B. RVer agrees to acquaint all guests with the conditions of tenancy in the Park, including, but not limited to, the Park's Rules and Regulations. RVer is personally responsible for the actions and conduct of RVer's guests.

C. Park Management reserves the right to determine whether the Park's recreational and other facilities can accommodate all the residents and their guests, therefore, Park Management may refuse any guest access to said facilities if the guest's presence would unreasonably detract from the use and enjoyment of these facilities by other RVer's who are then using the facilities.

D. A guest is only permitted to use the recreational facilities while accompanied by the RVer.

E. If the RVer is not or will not be present, then no guest(s) may occupy or otherwise use the RV or Premises without Park Management's consent.

7. RECREATIONAL VEHICLE AND ACCESSORY EQUIPMENT STANDARDS.

A. Recreational Vehicles.

1. Only RV's as defined by Health & Safety Code Section 18010 (which are identified as a motor home, travel trailer or park trailer and which are 1993 model year or newer (older with Park Management's approval)) are permitted to be placed on the Premises.

2. Only one RV may be placed on each space. No tents may be placed on Premises.

3. Site assignment and placement of RV shall be determined by Park Management and may be changed at any time as park demands necessitate. In no event shall a RV be located closer than six feet from any building or other RV situated on an adjacent space. Regarding the size of the RV permitted relative to each individual space, prior written approval of Park Management is required before RVer may place RV on the Premises.

4. All RV's within the Park must be properly licensed and insured. The current registration and proof of insurance must be maintained in the RV and available for inspection on Park Management's request.

5. Only self contained RVs (up to forty-five feet) are accepted. Each RV must have at least two (2) holding tanks.

6. If your RV is equipped with a washer/dryer you may not use them in this park as it will overload and damage our system and/or honey-wagon. You may use our laundry facilities or use the local ones in town.

B. Accessory equipment and structures.

1. The installation by RVer of any accessory equipment and/or structures on the Premises is prohibited without Park Management's prior written approval. All such equipment and structures must comply with all laws and ordinances. Any accessory equipment and structures or appliances not in compliance with the Park's residency documents shall be removed from the Premises by the RVer within seven (7) days of receipt of written notice. Upon termination of RVer's tenancy, it is RVer's responsibility to remove any accessory equipment and/or structures which the RVer has installed upon the Premises. Forfeiture of deposit will occur if the Park staff have to clean up the space.

C. Standards for accessory equipment and structures.

1. Cabanas, gazebos and decks. RVer may not install a cabana, gazebo or deck on the Premises

2. Storage building may be installed on Premises with Park Management approval. Standards are 8' wide by 8' wide by 7' high and must be a Rubber Maid shed and placed on space as to not affect all RVer's vehicles from being parked on space.

3. Air conditioners must be mounted to RV and must be in good operating condition and must not make excessive noise as to disturb any other tenant.

4. Fences are prohibited on Premises

5. Antennas including but not limited to TV, Ham and CB as well as Satellite dishes may not exceed 4 feet above the top of RV.

6. At no time may a tent be placed on the Premises or anywhere on the Park.

8. GENERAL MAINTENANCE OF RECREATIONAL VEHICLE AND PREMISES.

A. Recreational vehicle and accessory equipment.

1. Each recreational vehicle must be in good condition and kept in proper repair as determined by Park Management.

2. All accessory equipment must be in good condition and kept in good repair as determined by Park Management.

3. All doors, screens, windows must be in good condition and kept in good repair as determined by Park Management.

4. If any portion of the exterior of the RV or it's accessory equipment, structures, or appliances are damaged, the damage must be repaired or replaced within seven (7) days of written notice.

B. Premises.

1. Each RVer is responsible for the maintenance and appearance of RVer's  Premises

2. The Premises must be kept free of weeds, litter, debris, unsightly articles at all times as determined by Park Management.

3. To avoid damage to Park utilities, no digging or driving rods or stakes into the ground is permitted. RVer shall bear all costs of repairs to any utilities or Park property damaged by RVer.

4. At no time shall rope, wire, cable or any other such object or items be tied to trees or other poles inside the Park

5. Without Park Management prior written approval, RVer may not place any plant into the ground on the premises. Plants shall be properly maintained (including but not limited to, trimming all potted plants, potted shrubs, vines and bushes to prevent such plants from being excessively high or blocking a neighbor's view or brushing against a neighbor's RV or awning). Vegetables in pots are permitted on Premises with Park Managements written approval.

6. Any damage to the Premises which is caused by RVer or by RVer's guest(s) must be repaired or replaced within seven (7) days of written notice.

C. Storage.

1. Storage of anything beneath, behind or around the outside of the RV is prohibited. This includes, but not limited to, storage of boxes, trunks, wood, pipe, bottles, tools, mops, ladders, paint cans, surf boards or any other item which is unsightly in appearance as determined by Park Management.

2. No appliances, including, but not limited to, refrigerators, freezers, water heaters, air conditioners, washing machines, clothes dryers may be installed or placed outside of the RV at any time.

3. Only portable outdoor patio furniture which is in good condition and approved by Park Management may be used on any portion of the Premises (outside of the RV). Neither indoor furniture of any sort nor exercise and/or gym type equipment may be placed outside of the RV.

D. Hazardous substances.

1. Anything which creates a threat to health and safety shall not be permitted on the Premises.

2. For the purpose of this provision, "Hazardous substance" refers to any flammable, combustible, corrosive, explosive or toxic fluid, material, chemical, solid, gas or substance. (Including, but not limited to, paint, motor oil or other vehicle fluids, herbicides, insecticides, poisons, chemicals or other toxic materials.

3. No hazardous substances may be stored on the Premises, except those customarily used for normal household purposes (and only in quantities reasonably necessary for normal household purposes which shall be properly stored within the RV and/or storage building).

4. RVer shall not dispose of any hazardous substances under or about RVer's Premises, other home sites in the Park, the Park's common areas or any other area of the Park (including, but not limited to, the sewer system, or other drainage area or the ground beneath RVer's RV, accessory equipment or elsewhere on the Premises).

5. In the event RVer stores or disposes of hazardous substances under or about RVer's Premises or elsewhere in the Park, RVer shall immediately and appropriately remove the hazardous substances at RVer's own expense. If the RVer fails to remove the hazardous substances within seven (7) days after Park Management gives RVer written notice to remove the hazardous substances, the actual cost of such removal shall be immediately due and payable to the Owner. RVer agrees to indemnify Park against (and hold harmless from) any loss, liability, damage or expense, including, without limitation, reasonable attorneys' fees, which (either directly or indirectly) Park may incur or suffer by reason of the storage or disposal by RVer of any hazardous substances on or under RVer's Premises, other home sites in the Park or any other areas of the Park.

E.  Utility Pedestal.

1. The utility pedestals (water, irrigation, sewer and utility hookups) must be accessible at all times.

2. RVer's sewer and water connections must be water tight and air tight. Holding tanks must not have any leaks.

3. If one of the Park's water, irrigation shut off valves or utility cans is located on RVer's Premises, it must be kept uncovered and accessible at all time.

4. Except through existing electrical, water, sewer, phone, cable or natural gas outlets on the Premises (and only if RVer has contracted for such services), RVer shall not connect any apparatus or device for the purposes of using electric current, water service, sewer service, phone service, cable service, or natural gas service.

5. RVer shall at no time tamper with or adjust any utility on the park. Utilities to include water, irrigation, electric, cable, telephone, natural gas and propane.

6. Whenever it is necessary for Park Management or staff to make repairs or improvements to the Park's utility systems, Park Management will have the right to suspend temporarily the delivery of the affected utility/utilities. However, a reasonable notice will be given to RVer as circumstances permit. All such repairs and or improvements will be completed as safety and rapidly as may be practical and if possible, at such times which will cause the least inconvenience to the RVer and the Park.

F. Licenses and fees.

1. All vehicles within the park must bear a current license and decal issued by an appropriate state agency. Any fee, tax or registration charge for RVer's RV by any county, state or federal agency must be borne by RVer.

G. Propane.

1. Propane tanks must be disconnected from any RV (except motorhomes) and brought by RVer to the filling area. Park employees are not permitted to disconnect or reconnect propane tanks at any time. A propane tank must be in date (12 years or less). Any tanks older than 12 years must be recertified by a licensed propane dealer and the collar stamped with recertification data before it can be filled. All tanks #4 to #40 must have an O.P.D. (Overflow Prevention Device) valve, #100 must have a welded collar and/or cap covering valve assembly.

H. Garbage and trash disposal.

1. Garbage must be wrapped and, with other refuse, must be placed in plastic trash bags and kept inside the RV until deposited in the designated dumpsters.

2. Sanitary and health laws must be obeyed at all times.

3. Combustible, noxious, or hazardous materials should be removed from the Park and not placed in dumpsters.

4. Lids on the dumpsters must be kept closed at all times.

5. At no time are dumpsters to be loaded with any items that the lids can not be closed completely. At no time are the dumpsters to be loaded with landscaping and pruning matter that makes disposal of other residents garbage impossible. All materials, garbage, trash must be placed inside of a dumpster. Materials, garbage, trash at no time is to be left in the bays around the park as this constitutes dumping and will be prosecuted to the fullest extent of the law.

6. Bringing in trash from outside the Park to dump in the Park's dumpsters is strictly prohibited.

7. Dumpsters will be picked up by a local refuse hauler on a regular basis.

9. ADVERTISEMENTS.

A. The Park shall require the removal of a RV from the Park in the event of the sale of the RV to a third party.

B. No "For Sale" signs are permitted outside RVer's RV. However RVer may place a sign in the window of the RV (on the side of the RV facing the street) stating that the RV is for sale or exchange. Such sign shall not exceed twelve inches (12") high and twenty-four inches (24") wide, such sign shall state only the name, address and telephone number of the RV owner or agent.

C. Patio sales, moving sales and yard sales are expressly prohibited. A once a year park wide yard sale will be scheduled for your convenience to sell your unwanted items.

10. ENTRY UPON PREMISES OF THE RVER.

  A. Park Management and staff shall have the right of entry upon the Premises for maintenance of utilities and for maintenance of the Premises where the RVer fails to maintain the Premises in accordance with the Rules and Regulations, and for the protection of the Park at any time. Park Management will make every attempt to make entry at times to cause the least amount of disturbance to the quiet enjoyment of the RVer, emergency notwithstanding. Park Management may enter any recreational vehicle without prior written consent of the RVer in the case of an emergency or when the RVer has abandoned the RV.

11. RECREATIONAL FACILITIES.

A. Recreational facilities are provided for the exclusive use of RVers

B. Hours of the recreational facilities and additional rules and regulations governing the use of the recreational facilities are posted in and about the facilities and are incorporated into these Rules and Regulations by reference.

C. In no event is the drinking of alcoholic beverages allowed in any common area of the Park, including, but not limited to, the clubhouse, outside of the clubhouse, the store, the recreation building and or within fifty feet (50') of the swimming pool. No glassware or bottles may be taken into the recreation areas.

D. RVers must wear a shirt or jacket at all times inside common areas and park buildings (pool excepted). Footwear must be worn in all Park buildings.

E. Smoking is prohibited in the clubhouse or any other enclosed areas of the Park's common facilities.

F. No one may put their feet against the wall, windows or tables within the recreational areas.

G. Screaming, running, horseplay and loud noises are not allowed in the recreational areas.

H. Recreational facilities rules may be changed or revised as needed and pursuant to governing law.

I. Radios, CD players, IPODS, boom boxes, televisions, and other such entertainment devices are not permitted in the clubhouse and recreational facilities of the Park, unless used with earphones and not to disturb others.

J. Unless with prior written approval of Park Management, the clubhouse or rooms in the clubhouse may not be reserved for private parties, meetings or other functions.

K. The recreational facilities will be closed from time to time at Park Management's discretion for cleaning, repairs and for scheduled meetings.

12. SWIMMING POOL RULES.

A. Persons using the pool must do so at their own risk. There is no lifeguard on duty.

B. Swim fins, dive masks, rubber floats, air mattresses and the like are not permitted to be used when others are using the pool.

C. The swimming pool is heated only between the months of May to September of each year.

D. Children under eighteen (18) years of age may not use the pool unless accompanied by one of their parents at all times.

E. Pool is for the use of residents only.

F. All persons who are incontinent or who are not "potty trained" are not permitted in the pool, unless they wear swim diapers.

G. Smoking, food and drinks are prohibited inside the pool fenced area.

H. All swimmers must shower before entering the pool.

I. For protection of the pool furniture, please place a towel over the furniture when using sun tanning products. No person may enter the pool with sun tanning products on their bodies.

J. No one with a skin disease or open wound will be permitted in the pool area.

K. Shoes or sandals must be worn to and from the pool area.

L. Park Management reserves the right to limit the use of the pool at any time and to restrict the use of the pool by anyone.

M. Pool hours and additional pool rules are posted in the pool area and are incorporated herein by this reference.

13. RESTROOM AND SHOWER FACILITIES.

A. The restrooms and shower facilities are for RVers only.

B. These facilities will be closed from time to time at Park Managements discretion for cleaning and repairs.

C. Additional rules and regulations governing the use of this facility are posted and are incorporated herein by reference.

14. LAUNDRY FACILITIES.

A. The laundry facilities are for RVers only.

B. These facilities will be closed from time to time at Park Managements discretion for cleaning and repairs.

C. Washers, dryers and all other laundry facilities are to be cleaned by the RVer, inside and out immediately after each use. Clothes are to be removed from machines as soon as cycle is completed. Dyeing of clothes is strictly prohibited. Pet laundry may not be done in our machines. The laundry facility is to be left in a neat, clean and orderly condition.

D. Additional rules and regulations governing the use of this facility are posted and are incorporated herein by reference.

15. PARKING.

A. Violations of the following rules will result in the RVer's vehicle being towed at the RVer's expense. In addition to the RV, only two (2) other "permitted vehicles" may be parked on the RVer's Premises, both of which must be parked in/on the RVer's Premises and may not extend out into the roadway. All of the RVer's vehicles defined as "other vehicles" or in excess of two (2) in number must be parked outside of the Park or in the extra vehicle parking/storage area (for an additional monthly fee). No parking on any red painted curb inside of Park and around the Park entrance and exit areas.  

1. "Permitted vehicles" specifically include sports cars, coupes, sedans, station wagons, vans and pick up trucks under one (1) ton, or sport utility vehicles. Not included as permitted vehicles are "other vehicles" such as campers, buses, trucks, tractors, boats, personal water craft, trailers (except the RV occupied by the RVer), dune buggies, motor scooters, mini-bikes, mopeds, and other wheeled motorized or self propelled transportation.

2. A pick up truck or van may not, without Park Management's consent, be substituted for one of the two permitted vehicles if it is equipped with storage containers or compartments or other similar devices or contains tools or equipment which are mounted on the outside of the vehicle or are otherwise visible from the street or adjacent RVs.

3. Notwithstanding anything contained herein to the contrary, a motorcycle may be substituted for one of the two permitted vehicles only with Park Management's consent. No more than two (2) motorcycles may be parked on the RVer's pad at any time. the permission to park a motorcycle does not relieve RVer of the obligation to abide by all other rules and regulations relating to vehicles.

B. Parking is permitted only in designated areas. Unless otherwise posted or permitted by these Rules and Regulation, no parking is permitted on the streets of the Park, except for the purpose of loading and unloading and only during the hours of 7:00 a.m. and 10:00 p.m. and only for one (1) short period (not to exceed fifteen (15) minutes)) per day. Any vehicle belonging to a RVer which is temporarily parked on the street must be parallel parked in front of RVer's Premises.

C. The yellow curb located on the West side of the clubhouse is restricted to five (5) minute parking or to deliveries by vendors. Vehicles belonging to delivery persons, repair persons, health care providers and park employees may be parked for longer periods of time on the street immediately adjoining the home site where repairs are being performed or where services are being provided.

D. Vehicles (including, but not limited to, motorcycles) parked on RVer Premises may only be parked on the driveway, and not on the landscaped or other areas of the Premises parking is not permitted on vacant home sites.

E. Guests may not park for more than twenty-four (24) hours in guest parking spaces, beyond twenty-four (24) hours, guest may only park outside of the Park or on the host RVer's Premises. Because of the limited parking facilities, traffic congestion and noise, Park Management reserves the right to restrict the number of guests bringing automobiles or other vehicles into the Park.

F. Any vehicle parked in violation of these Rules and Regulations or in violation of signs posted through out the Park may be towed from the Park at the expense of the vehicle's owner.

G. Sleeping in vehicles (other than RVer's RV which is located at the Premises is prohibited.

H. No vehicle may be "stored" on the Premises. "Storage" shall include, but not limited to, the parking of an inoperative vehicle that is not used for a period exceeding forty-eight (48) hours. The parking of an operative vehicle that is not used for a period exceeding four (4) weeks or the parking of more than one vehicle for the purpose of selling those vehicles as part of a commercial activity.

I. No permanent parking of trailers, trucks one (1) ton or larger or boats is permitted in the driveways. Permanent parking shall include, but not limited to, parking for a period exceeding twenty-four (24) hours or parking on the Premises or the street more than five (5) time in any one month, except for short periods (1 hour) for loading and unloading.

J. A limited number of parking spaces are available for travel trailers, boats, campers, trucks and extra vehicles on a first come first served basis. By providing such spaces to the Residents, Park Management is providing a service, but is not under any obligation to provide such a service. Therefore, Park Management may impose an additional fee for the storage of any vehicle, boat or trailer. Vehicles in the storage area may not be used for sleeping or any other activity, and no maintenance work may be performed on any vehicle in the storage area.

16. MOTOR VEHICLES AND BICYCLES.

A. No vehicle leaking oil or any other substances or fluids shall be allowed in the Park. Any car dripping oil or gasoline/diesel must be repaired immediately.

B. Maintenance, repair or other work of any kind on any vehicle including, but not limited to, cars, trucks, motorcycles, boats or trailers (including the RV the RVer resides in) is prohibited anywhere in the Park. This includes, but not limited to, changing of oil, tires etc.

C. Vehicles may only be washed at the dump station or outside of the Park.

D. For the safety of RVer's and guest's no vehicle may be operated in an unsafe manner, all traffic signs must be obeyed.

E. Pedestrians, bicycles and golf carts shall be given right-of-way.

F. No vehicle (including, but not limited to motorcycles and A.T.V.'s) may be operated in the Park by any person who is not properly licensed by a state agency to operate a motor vehicle. All vehicles operated within the Park must be registered and licensed for street usage.

G. Excessively noisy vehicles are not permitted in the Park.

H. Motorcycles, motor scooters, mini bikes, mopeds or other motorized two three and four wheeled modes of transportation not automobiles entering and /or leaving the Park must be driven the most direct route between the Park entrance and the RVer's Premises and may not otherwise be driven on any other street in the Park. All such vehicles shall be equipped with mufflers or other necessary noise suppressing devices.

I. Bicycles may only be driven on the roadways and must obey the same traffic regulations as cars. In the Park, bicycles, skateboards, roller skates and rollerblades are not permitted on sidewalks, grass, vacant home sites, or in or around the recreational facilities.

J. If driven at night or at dusk, bicycles must be equipped with a light on the front and a reflector on the rear.

K. Vehicles (including motorcycles) are not permitted in the Park unless they are regularly maintained in a normal operating condition and are neat and clean in appearance. This includes, but is not limited to, vehicles whose exterior appearance has deteriorated to a point of being unsightly as determined by Park Management.

L.  Youth Helmets CVC21212. A person under 18 years of age shall not operate a bicycle, a non-motorized scooter, or a skateboard, nor shall they wear in-line or roller skates, nor ride upon a bicycle, a non-motorized scooter, or a skateboard as a passenger, upon a street, bikeway, as defined in Section 890.4 of the Streets and Highways Code, or any other public bicycle path or trail unless that person is wearing a properly fitted and fastened bicycle helmet that meets the standards of either the American Society for Testing and Materials (ASTM) or the United States Consumer Product Safety Commission (CPSC), or standards subsequently established by those entities. This requirement also applies to a person who rides upon a bicycle while in a restraining seat that is attached to the bicycle or in a trailer towed by the bicycle. The parent or legal guardian having control or custody of an un-emancipated minor whose conduct violates this section shall be jointly and severally liable with the minor for the amount of the fine imposed pursuant to this subdivision. Violations are punishable by a fine of not more than $25.

17. CONDUCT.

A. Actions by any person of any nature which may be dangerous or may create a health and safety problem or disturb others are not permitted. This includes, but is not limited to, any unusual, disturbing or excessive noise, intoxication, quarreling, threatening, fighting, immoral or illegal conduct, profanity, or rude, boisterous, objectionable or abusive language or conduct.

B. The use or display of any weapon including, but not limited to, a bow and arrow, BB guns, knives, fireworks and firearms, guns are expressly forbidden. Persons under the influence of alcohol or any other substance shall not be permitted in any area of the Park which is generally open to residents and their guests.

C. Radios, televisions, record players, musical instruments and other devices must be used so as not to disturb others. Ham, CB radios or other transmitters may not be operated in the Park.

D. RVers and their guests shall not encroach or trespass on any other person's site or upon any area which is not open for general use of RVers and their guests. All Park property which is not for the use of residents and their guests, including, but not limited to, gas, electric, water and sewer connections and other equipment connected with utility services and tool and equipment of Park Management, shall not be used, tampered with or interfered with in any way by any RVer.

E. RVers and their guests must be quiet and orderly and shall not be allowed to do any thing which might be cause for complaint. RVers must acquaint guests and all occupants of the RV with the Park's Rules and Regulations.

F. The use of baseballs, footballs, or other flying objects within the Park is prohibited.

G. Except for barbecues and propane powered campfire devices approved for use by Park Management or appliances installed in RVer's RV, no outside fires are permitted.

H. The RV and Premises shall be used only for private residential purposes and no business or commercial activity of any nature shall be conducted thereon. This prohibition applies to any commercial or business activity, including, but not limited to, the following:

1. Any activity requiring the issuance of a business license or permit by any governmental agency.

2. The leasing, subleasing, sale or exchange of RVs.

I. The violation of any law or ordinance of the city, county, state or federal government will not be tolerated. No acts or demeanor shall be permitted which would place the Park Management in violation of any law or ordinance.

J. The climbing of any tree, fence, post or Park structure is expressly prohibited.

K. RVer is responsible for the actions and conduct of all other occupants or residents of the RVers RV and for the actions and conduct of the RVers guests and invitees. Such responsibility shall include, but is not limited to, financial responsibility for any breakage, damage, destruction or vandalism either purposeful or accidental of the Park's property including, but not limited to, any utility system, recreational facility and/or common area.

18. PETS.

A. Special permission to keep a house pet in the Park must be obtained from Park Management. A house pet is defined as a pet that spends it's primary existence within the RV. This includes dogs, cats, fish, birds or any animal approved by Park Management. Park Management reserves the right to deny a RVer a pet if there are an excessive number of pets in the Park or if a proposed pet would pose a threat to the health and safety of residents of the Park. No more than a total of two (2) pets (dogs and cats) are permitted per RV.

B. The types of pet permitted are: dog, cat, small birds, fish and other usual household pets approved by Park Management. Only dogs and cats which at maturity weigh no more than forty (40) pounds are permitted.
Banned breeds: Pit bulls or any mix thereof, Mastiffs and any mix thereof and any other breed that shows aggression towards other animals or humans.

C. Non-house pets (including farm animals) are prohibited under any circumstances. Strange and exotic pets are not permitted.

D. Park Management must approve in writing all pets before application to rent is accepted. After moving into the Park, a pet may not be acquired without the written permission from Park Management.

E. If a pet is lost or dies, written permission to acquire a new pet must be obtained from Park Management.

F. Park Management reserves the right to charge a fee for keeping a pet in the Park.

G. If any of the rules regarding pets is violated, and such violation is noted by Park Management or a complaint is made by another resident and investigated by Park Management and found to be valid, the owner of the pet will receive a written notice stating that a complaint has been filed and one (1) warning will be given. The second offense with the pet owner the owner will receive a second notice stating the right of the owner to keep a pet within the Park has been terminated along with a seven (7) day notice to remove the pet from the Park.

H. The following rules must be strictly followed by all pet owners.

1. All pets must be on a leash when not in the RVers RV (County ordinance) Violation will result in animal control becoming involved.

2. Any pet running loose will be trapped and/or captured and taken to animal control. Second offense will result in termination of RVers right to keep a pet on the Park.

3. Each pet must be licensed and vaccinated and have a current rabies tag in accordance with local law. evidence of such licensing, vaccination and rabies tag shall be submitted to Park Management within seven (7) days of receipt of written request for such information.

4. Pets are not permitted in the clubhouse or any recreational area at any time. (Service dogs excluded except for the pool area.)

5. Pets will not be allowed to cause any damage or any disturbance which might annoy neighbors, including, but not limited to, barking, growling, biting, showing aggression, or any other unusual noises or activities or damage. Under no condition is a pet to invade the privacy of anyone's home site, flower beds, shrubs, etc. If a pet has damaged the lawn area on RVer's home site, then RVer will be charged for replacement or restoration of the damaged lawn area.

6. Pets are not permitted to be walked in the Park, but may be exercised along Ogier Avenue or the area beyond the end of Ogier Avenue (which is a county park). If RVer's pet is allowed to exercise in RVer's yard or elsewhere, all excrement must be picked up, wrapped in a plastic bag, and placed in the trash immediately.

7. Unless with prior written approval of Park Management, no exterior pet housing is permitted in the Park. This includes, but is not limited to, any type of confining barricade or structure.

8. Guests are not permitted to bring any pets in to the Park.

9. The feeding of stray animals is strictly prohibited.

10. The tying up of pets outside the RV and leaving them unattended is prohibited.

19. RENTING, SUBLETTING OR ASSIGNMENT.

RVer shall not sublease, rent or assign RVer's RV, the Premises or any rights or interest that RVer may have under RVer's registration agreement or rental agreement.

20. FIXTURES.

All landscaping and structures or other improvements permanently attached to or embedded in the ground shall become a part of the realty upon their installation and belong to the Park Owner. Upon RVer vacating the Premises, such improvements shall remain upon and be surrendered with the Premises. Park Management may, however at it sole option, permit or require RVer to remove, at RVer's own expense, said improvement. RVer shall repair any damage to the Premises caused by the removal, including, but not limited to, the filling in and leveling of holes or depressions and shall leave the Premises in a neat and uncluttered condition with the Parks original engineered grade intact.

21. PARK OFFICE, COMPLAINTS AND MAINTENANCE PERSONNEL.

Except in emergency, please do not telephone or contact Park Management and staff after normal business hours. Except for emergencies, all complaints must be in writing and signed by the person making the complaint. All community business is conducted during posted business hours. All repair or maintenance requests regarding common areas shall be submitted in writing to Park Management, and RVer shall not give instructions directly to Park staff. RVer shall not request maintenance staff to perform jobs for the RVer (whether or not for remunerations), since Park maintenance staff are expressly prohibited from undertaking any work on behalf of RVers.

22. REVISION OF RULES.

Park Management reserves the right to add to, delete, amend, and revise these Rules and Regulations from time to time, as well as additional rules and regulations and hours posted in and about the recreational facilities.
